Is Ditech driving you crazy? Well if so you're not alone. I'm Consumer Financial Protection Attorney Mike Cardoza and I'm here to tell you that mortgage servicer company Ditech is driving lots of people crazy. I'm shooting this video in part because of all the phone calls that I'm getting from people who are at their wit's end. Some of them are convinced that Ditech is persecuting them and trying to take their house. Others that Ditech is just harassing them and sending them through all kinds of painful emotional evolutions. I'm here to tell you that sometimes neither of those things are the case. This company may just not know what it's doing from one hand to the other hand.

Here's what I've got for you today. Listen carefully. Stop talking to Ditech. Don't get on the phone. Don't send emails. Don't think about Ditech at night and how you had a conversation with so-and-so and you wrote their name down. Just forget about it because as you've noticed, everything that they tell you on the phone isn't true or doesn't come to pass. You ask for a letter, they promise to send it. It never arrives. That's not unusual whatsoever. Okay? It's not you, it's them. The only way that you're going to communicate effectively with this company is through what's called the Qualified Written Request. It's a very specific legal term. It's encoded in the RESPA, the Real Estate Settlement Procedures Act and it's the one thing that makes them either answer your questions in writing or else be subject to the penalties of that law and some others as well.

If you need help figuring out how to do this and where to send it, here's a trick. The post office box for QWRs for Ditech is just on number different than the post office box for customer service complaints. Think about that for a second.

Anyway, let me help you out with figuring out how to construct a QWR and where to mail it and how to mail it and so on and so forth. The most important thing is that you don't have to go through this anymore. Don't pick up the phone. Don't send any emails. Don't do anything that doesn't create a permanent record and subject them to liability. If you feel like you're being persecuted by this company, you're getting bills that are inaccurate, you pay your taxes but yet they’re still withdrawing part of your monthly payment into an escrow that's then going nowhere - or they've told you that they've refunded your escrow amount, but it actually went back to them and now you can’t get ahold of it…

You think I'm making this stuff up, but I'm not. It happens. Stop the madness, reach out, get some help. Let me help you figure out where to go next because a lot of times - some of these companies - all they listen to is a lawsuit.
